Terms of Use (EULA)

This Terms of Use document serves as Pretzel Rated's End User License Agreement (EULA) for App Store users.

1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the Pretzel Rated mobile application and related services (the "Service"), operated by Ignacio Juarez ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old. If we learn that we have collected personal information from a user under the age of 13, we will take steps to delete the account and associated data.

3. Account Registration

To use certain features, you must create an account. You agree to provide accurate and complete information, keep your account credentials secure, and notify us immediately of any unauthorized use. You are responsible for all activity under your account. You may not create more than one account per person.

4. User Content

The Service allows you to post reviews, ratings, comments, lists, and other content ("User Content"). You retain ownership of your User Content. By posting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute your User Content solely for the purpose of operating, promoting, and improving the Service.

You are solely responsible for your User Content. You represent that you have the right to post it and that it does not violate any third party's rights or applicable law. You may delete your User Content at any time, though copies may persist in other users' feeds or in backups for a reasonable period.

6. Subscriptions and Payments

Pretzel Rated offers optional paid subscription plans — Pretzel Member ($24.99/year) and Pretzel Critic ($49.99/year) — that unlock additional features. Subscriptions are processed and billed through the Apple App Store.

Auto-Renewal: Subscriptions automatically renew unless you turn off auto-renewal at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the confirmed subscription price.

Managing Subscriptions: You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Refunds: All payments are non-refundable except as required by applicable law. If your subscription lapses, you will lose access to premium features, though your account and content will be preserved.

7. Third-Party Services

The Service integrates with third-party services, including but not limited to The Movie Database (TMDb) for media metadata, Apple for payments and authentication, and others as described in our Privacy Policy. We are not responsible for the availability, accuracy, or content of third-party services.

You acknowledge and agree that Apple, Inc. is a third-party beneficiary of these Terms, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Media information displayed in the app is sourced from third parties and may contain inaccuracies.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless Pretzel Rated, its operator, and any affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

11. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion, with or without notice. You may delete your account at any time through the app's settings. Upon termination, your license to use the Service ends immediately, though provisions that by their nature should survive (including ownership, disclaimers, indemnification, and limitations of liability) will remain in effect.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the app or by other means. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
